Is gifting legal?
Yes! It has always been legal to give! Citizens of free
countries around the world have a legal and Constitutional right to give
property, cash, and other assets of value as established by law. In the United
States we have the Preamble, the Constitution, and the Bill of Rights to
protect a private citizen's right to earn, pay taxes, and give away property
and cash as long as it is done according to the laws and codes of this
country. In Gifting, individuals choose to give freely, and cannot lose money
because a gift given unconditionally cannot be lost! You can't lose what you
give away! In Tender Hearts we give freely expecting nothing in return from
the recipient of the gift, and there are no promises or guarantees!
Furthermore, the U.S. gifting law, found in the IRS Tax Code, Title 26,
Sections 2501 - 2504 and 2511, states that one or more individuals can give a
gift or gifts to another individual of up to $12,000 per calendar year without
and tax liability being incurred by the recipient of the gift
(see
http://www.irs.gov/publications/p950/ar02.html) . Since the
taxes on the gift have already been paid and the gift is not given in exchange
for a product or service, and it's NOT an investment, these gifts are not
required to be reported as gross income of the recipient
(See 26 USC § 102).
What is the Tender Hearts Belief System?
Tender Hearts is a "Private Activity." Our belief system is born of the Law of
Attraction and Intention to Empower. Our vision is to create the You and Me
World by providing models and information where participants can have an
actual experience of the truth that Abundance is created through giving.

How Many Years has Tender Hearts been in Existence?
The giving philosophy has been practiced for many
centuries as a way to share wealth and bless the lives of others. This concept
was launched online in 2000.
What is the Company?
Tender Hearts is not a company, business, or Investment
Club. We are a belief system, (simply individuals who believe in giving freely
to one another unconditionally) with a pure intent to Empower! We are
committed to teach people of all backgrounds that they can live an abundant
life! We believe it's a divine experience to give freely and unconditionally.
Who can Participate?
Tender Hearts is a private activity and belief system.
Invitations' are extended to participants of like mind who are over 18 years
of age, who have read and chosen to trust in our belief system. We believe
anyone with a kind heart and a desire to bless others can participate in this
activity.
Are There Any Fees for Participating?
Tender Hearts does not charge a subscription fee. The
participants voluntarity covers costs associated with running the activity
including the hardware, software, programming, maintenance, and service the
24/7 worldwide website and other support systems. Every participant uses the
same website.
Do I Need a Computer to Participate?
A computer is not absolutely necessary but does make staying in touch easier.
Since Tender Hearts utilizes internet communication, some kind of Internet
access is necessary. Extensive email systems are used to keep participants
updated. For those who don't have a computer, consider having a family member,
friend, or Inviter, with a computer, help you get started. Please be sure it
is someone you know, love and trust! In most areas, public libraries have
Internet ready computers available to the public and staff who will teach you
the basics of how to use them. As soon as you're able, it's a good idea to get
your own internet access so you can be empowered with all the awesome services
available in Tender Hearts.
Do I have to "Recruit" People?
In this Activity we simply "Share" information. We
believe the first gift you receive is the Invitation itself. Tender Hearts
exists because participants truly grasp the spirit of "People Helping People."
There is no need to "sell" or pressure anyone to participate. We believe our
Philosophy of 'Living the Law of Reciprocity' through sharing is a time tested
way to live. The Activity is for like minds who believe in the universal
concept of "What You Give in Life Will Come Back Many Times Over."
What is a Personal Invitee?
A Personal Invitee is a person who has accepted a
invitation to participate from your website or has been passed up during a
qualification process of another participant. This is a real person or entity,
who has accepted the activity agreements and beliefs, and chosen to be a
systematic giver, receiver, and inviter, not just a name entered into the
tracking system.
Who Do I Invite?
You will not directly invite unless you are a team
leader. You will simply share information and Tender Hearts will determine who
to invite. All participants are free to share this Good News with any
link-minded person. Team Leaders and your inviter can direct you to additional
resources designed to help find others of like mind. It would surprise you to
hear how many folks have said... 'I have been looking for something like this
all of my life!' This Tender Hearts Philosophy of caring and sharing strikes a
cord with so many people!
Am I Expected to Invite My Family and Friends?
We have many families who participate together and have
created an abundant energy all around them. All those who accept the
invitation would do so with the intention to empower and be an active
participant in this belief system. We are about Education and Inspiration! If
your friends or family can embrace our belief system and choose in to being a
gift we welcome them with open arms.
If you decide to upgrade, you will simply pay the pro
rated difference at the time of the upgrade. Remember, if you elect to
participate in only one program, you will be subject to roll up.
Can I re-invite active participants and have them
connected to me with a new ID number?
No. All participants accept the activity agreements
before participating. One of those agreements is to honor the inviter/invitee
relationship and protect the integrity of the activity. Please remember...

Is it Okay for Tender Hearts Participants to Have
Gatherings?
Tender Hearts is a private belief system. Our gatherings
are not open to non participants for any reason. This is in direct violation
of what is legal and any participant who has a gathering or meeting that is
not for participants only will be terminated and will no longer be eligible to
receive. This includes gatherings online, including forums and chat rooms. You
may share information about The Law of Attraction and send people to our
website, but you may not give the websites out. People must freely choose to
request the information to get details about who we are and how our activity
works. This is part of what keeps our system legal. Before any participant may
have a member gathering, it must be approved by the Tender Hearts council of
team leaders and must be advised and made available to all Tender Hearts
participants. This includes online gatherings, web conferences and
teleconferences. We do not have individual "teams" at Tender Hearts. If you
wish to provide training in a group setting you must make it available to
every participant. It is very important to our activity that every participant
adheres to this guideline.
How Much Time Will I Have to Put Into This?
This is a personal choice. Since Tender Hearts is not a
business there are no quotas or requirements. Each participant can be as
active or as passive as desired. Please realize that the more each participant
shares, the greater the potential to receive.
How Long Does it Take to Qualify?
There is no time limit to inviting. Support systems are
in place to assist you with sharing the information with others. With the
support available, no participant should ever feel alone in this belief
system. If you are not comfortable with sharing life altering information,
this activity may not be for you.
Is there a limit on how many gifts I can receive?
Absolutely not! Some participants receive several gifts
per day and some receive gifts every week and some every month. It all depends
on how many people you expose to the information. The IRS limits the amount
you can receive without a tax burden to $1 Million in a calendar year but you
may receive more than $1 Million in a calendar year through your participation
in Tender Hearts. If the abundance you receive exceeds $1 Million in a
calendar year, you should check with the IRS or a qualified tax advisor.
What About My Privacy?
Since this is a private activity, the guidelines
strictly prohibits participants from soliciting other participants for other
interests, activities, or businesses. Furthermore, the contract with our data
tracking service excludes them from sharing any participant's data with other
entities. Some participants also elect to use pseudo-names on their cycles for
further anonymity. We also believe giving can and should be done in a
discrete, respectful manner...embracing the spirit of giving with gentleness
and kindness.
What is a Gifting Statement?
A Gifting Statement is a legal document clearly
indicating that a gift given is indeed a gift and there is no expectation of a
return. Similar statements are used when money is gifted to someone for a
mortgage down payment or when a vehicle is given to another person. Since no
money is being invested, loaned, or otherwise given with the promise of a
return, each gift given must be accompanied by a gifting statement. You are
encouraged to click on the Gifting Statement link and read through it before
accepting the invitation or sending it to anyone.
What is a Non-Solicitation Statement?
This is a statement that each person who chooses to
participate must sign and give to their inviter to signify that he/she was not
pressured, enticed, or otherwise mislead into becoming an Tender Hearts
Participant. Each person interested in becoming a participant should first
review all information on this website and get any questions or considerations
addressed before accepting the invitation. You are encouraged to click on the
Non-Solicitation link, and read through the entire document to be sure you
understand our pure intent.
Is Tender Hearts a Pyramid?
No! Tender Hearts is a belief system born of the
intention to empower. Activity participants choose to exercise our individual
rights to give and receive acknowledging principles which govern the Law of
Attraction. One of these principles is found in Luke 6:38 (New Living
Translation) which states; "If you give, you will receive. Your gift will
return to you in full measure, pressed down, shaken together to make room for
more, and running over. Whatever measure you use in giving- large or small -it
will be used to measure what is given back to you."
How Do I Change My Password, Phone Number, Email
Address, Name, Etc?
We do not provide individual websites for the sake of
privacy and confidentiality.
How do I Add a New Participant?
You simply share the information about the Law of Attraction and allow
individuals to connect with the leaders themselves by requesting an interview
and then allow the team leader to guide them in the sign up process.
Where Do I Go for Help? How Can I talk with the
Leadership?
Simply submit a question via email or call the support center. Real people
(Team Leaders) answer those messages and would love to assist you with your
concerns. We also love your input and enthusiasm!
Can I Invite More Than Four People?
Yes! Yes! Yes! You could invite a hundred (or
more) people and they could all be connected to you. The qualification process
is an important part of the giving process. Remember, every person who signs
up after you are qualified begins building your giftings for you! Never give
your invitees away. Although this concept comes from a good place in your
heart, we are teaching people how to fish for a lifetime here by not throwing
them a fish a day. Remember, Our intention is to Empower!
How Long Do Inactive Participants Remain in Tender
Hearts?
We understand that personal situations change and
sometimes participants are not able to stay active consistently. If a
participant wants to voluntarily resign all they need to do is notify the Team
Leaders through an email or have their inviter notify on their behalf. Tender
Hearts strives to allow all participants the freedom to be active or in-active
at will and our intention is not to remove anyone who has an interest in
future activity. Tender Hearts reserves the right to remove inactive
participants who stall boards.
How Do I Send a Gift?
The receiver should let you know in what form and how
they would like to receive your gift. Please check with them before sending
your gift. Always include a Gifting Statement and Non-Solicitation Statement,
available from your sponsor, with your gift! Also...be sure to include you ID
number (username) and activity name (Tender Hearts $2000) so the Receiver
knows who to acknowledge for the fabulous gift.
